Welcome to The Constelling. These Terms & Conditions (“Terms”) govern all online purchases from our website. By placing an order, you agree to these Terms.
1. Company Details
This website is operated by Studio Stephanie Jeanne Marie Pte. Ltd., trading as The Constelling (“we”, “our”, “us”). We are a company registered in Singapore.
2. Products
We sell artworks, including originals, photographic prints, and limited editions. Images on our website are for reference only; minor variations may occur due to display differences or production nuances.
3. Orders & Payment
All prices are stated in Euro unless otherwise indicated. Prices may change without notice until an order is confirmed.
Payments are processed securely via Airwallex. Orders are confirmed once full payment is received. By completing a purchase, you represent that you are authorised to use the chosen payment method.
Currency conversions (if displayed) are approximate and provided for convenience only. Payments are processed in Euro unless otherwise indicated.
- Age and Legal Capacity:
By placing an order, you confirm that you are at least 18 years old and legally capable of entering into binding contracts. - Order Cancellation and Refusal:
We reserve the right to refuse or cancel any order if fraud, unauthorised payment, pricing errors, or listing inaccuracies are suspected. In such cases, any payment received will be refunded in full. - Availability and Accuracy:
While we take great care to ensure accuracy, we cannot guarantee that all product descriptions, prices, and availability details are error free. In the event of an error, we reserve the right to correct it before fulfilling any order.
4. Shipping & Delivery
We ship worldwide. Delivery times may vary depending on destination, carrier availability, and customs clearance. Estimated delivery timelines are provided as a guide only and are not guaranteed.
All shipments are covered by the shipper’s transit insurance for their declared value until delivery. In cases where artworks or prints are shipped directly from the artist’s studio or our printing partners, we ensure that the shipment is fully insured through the courier’s insurance service.
Buyers are responsible for any applicable customs duties, import taxes, or local fees. Risk of loss passes to the buyer upon delivery to the address provided.
5. Returns & Refunds
Under Singapore’s Consumer Protection (Fair Trading) Act (“CPFTA”), buyers are entitled to remedies for defective or misdescribed goods. If a work arrives damaged or materially different from its description, please contact us within 48 hours of receipt and provide clear photographic evidence of the item and its packaging at the time of delivery and unpacking. Claims without sufficient supporting evidence may not be accepted. We may offer a repair, replacement, or refund as appropriate under the CPFTA.
For photographic prints and digital artworks, all sales are final except where goods are defective or misdescribed. We do not accept returns or exchanges for change of mind.
For original artworks, we accept returns within 14 days of delivery, provided the artwork is returned in its original condition and packaging. The buyer is responsible for all return shipping, insurance, customs duties, and taxes, and for ensuring safe transit. Refunds will be issued for the artwork price only, excluding the original outbound shipping cost. Refunds are processed once the returned work is received in its original condition and inspected.
For artworks returned in accordance with these Terms, buyers are responsible for arranging return shipping and insurance for the artwork’s full value. We are not liable for loss or damage during return transit if the shipment is uninsured or improperly packaged.
We are not responsible for damage resulting from improper unpacking, handling, framing, hanging, storage, or environmental exposure after delivery. For high value artworks, buyers are encouraged to record the unpacking process to assist with any potential transit claims.
6. Intellectual Property
All artworks, images, and content displayed on this website remain protected by copyright and related intellectual property laws. Purchasing an artwork does not transfer reproduction, licensing, or commercial rights. No content may be copied, reproduced, or distributed without prior written consent from the artist or copyright holder.
7. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or related to your purchase shall not exceed the price paid for the artwork. We are not liable for any indirect, incidental, or consequential losses, including loss of profit, goodwill, or data.
8. Force Majeure
We are not liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to acts of nature, fire, flood, pandemic, war, embargo, strike, courier disruption, or government action. In such cases, we will take reasonable steps to resume normal operations as soon as possible.
9. Governing Law
These Terms are governed by the laws of Singapore. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
